Leaving the Country: If an employee resigns during probation to exit the UAE, they must give at least 14 days’ written notice. (Note: If the employee returns to the UAE on a new work permit within 6 months of leaving, the new employer must reimburse the previous employer's recruitment costs).
3. When Can a 1-Year Labour Ban Still Be Applied?
While general automatic 6-month bans are a thing of the past, MoHRE will impose a 1-year administrative work permit ban in specific breach-of-contract scenarios:
Unlawful Resignation During Probation: Leaving a role during the probation period without serving the mandatory 14-day or 30-day notice.
Absconding (Unlawful Absence): Abandoning work without informing the employer or providing valid legal cause.
Termination under Article 44: Being dismissed for severe misconduct (e.g., fraud, forgery, or safety breaches).
4. How Fixed-Term Contracts Streamline Job Mobility
All private sector workers in the UAE are employed under Fixed-Term (Limited) Contracts. This standardization eliminates ambiguity surrounding resignation terms. Whether you reside in Dubai, Abu Dhabi, or any Northern Emirate, the rules for ending or renewing a contract remain unified across MoHRE's central database.
