The Ministry of Labour has amended the labourers' Visa Transfer Law, which, I believe, are in favour of both - the labourers and the labour market. The ministry has ceased the previous condition that obligates the labourer to complete one year continuous service for his/her employer before being permitted to transfer his/her visa to another employer.
According to the new rule, the Ministry of Labour no longer requires such a condition. So, any labourer who has not completed a year's service for his/her employer may transfer to another employer after obtaining a No Objection Certificate (NOC) from the employer to transfer the visa to another employer, provided that the newly imposed fees should be settled. Such fees are called "the one year non-completion fees" which is calculated at the rate of Dh500 per month. For instance, if the employee continues a period of two months service only then he/she would be obliged to pay a fee of Dh5,000 for 10 months.
Now any labourer, who completes a period of three years service and who could not obtain an NOC, can resign and can approach the Ministry of Labour and the ministry - as per his demand - will cancel the visa and apply a six-month ban. With the new rules and upon completion of three years' service, this ban can be lifted and the employee can transfer to another employer without the need to obtain such NOC from the previous employer, provided that the newly imposed fees should be settled in addition to the visa transfer fees. Such new fees are called 'ban lifting fees'. Worth saying is that this new law is not applicable in Abu Dhabi but might be in the future. Therefore, the reader as per the new law will not have any problem as long as the company has promised to grant him a n NOC to transfer his visa.

Whether there is any ban after completion of 3 years of limited contract if i have given my non renewal letter only 20 days before the expiry of contract.In fact,i have not given 30 days notice before expiry of my contract.Hence there is shortfall of 10 days to fulfill the notice period and i have been asked that i have to work upto the notice period which will expire after 10 days of my contract expiry.If suppose i use to work beyond the contract expiry just to fulfill the notice period then in that case whether the employer can impose any ban or not.Please suggest me or give other advise to tackle the situation.

I was working in Dubai for a developer company from June 2009 till Jan 2011. My company gave me a redundancy notice as my position in the company was no more required due to a change in strata law. I was working as a Administrative supervisor, I have a Graduate Degree (attested by UAE consulate), my company has also promised to give me NOC. I got a job in the month of Feb 2011 & the new company applied for my visa but it got rejected, the reason was I have got a one year labour ban. What should I do to get this ban lifted...?
With due respect, I would like to inform you that I was working with a Dubai based Trading Company from onwards May 2004 on Dubai Visa and I got my work visa on 14th Oct 2004. I completed my first contract of three years with them and then further carried on my second contract of three years with them from 14th Oct 2007 till 14th Oct 2010. The commitments made by the organisation in writing to me were never fulfilled for years and that’s why I was forced to look for another opportunity. Luckily I got a nice opportunity and I informed my employer of the same and submitted my resignation in a legal way on 1st June 2010. The same was accepted by my employer by mail and I was assured that I will be relieved by them after a month time. To my surpise I was put on a ban of one year by my employer on 7th July 2010.
I would kindly like to know that since I had completed more than 5 years and 9 month service with my employer’s, still am I eligiable to get a ban of a year? It was a matter of only three months of my expiry of labour card which was about to expire on 14th Oct 2010.
I will really appreciate and will be greatful if you can kindly let me know the status regarding my Ban whether it still exist or taken off according to the new rules from 01ST Jan 2011.

I have a question to clear. I have worked in Dubai for 4 years in a hotel and went back home and recently came back on tourist visa to search for new job. I got a job offer confirmed by one of the hotel and just ysterday the employment visa is been issued, which I have told that its a labour visa. However, I haven't join this hotel company till now.I was also waiting for another job offer confimation from another hotel, which I got today. Will there be a ban for me, if I accept the second job offer and reject the first one. What is the solution to this kind of situation.

Hi! my name amit singh and i from nepal. i went dubai in august25/2011 and i returned back 30 september/2011. i stayed there 35 days only. i went in temporary work permit which is for 2 month. in my passport there is not stamping and i also informed my company 1 month earlier that stop all process because i dont want to stay so i didnt get any document like labour card or work permit. now is it possible to travel again dubai in employment visa or any ban for me. plz reply me soon in my mail which is amit_singh96653@yahoo.com

I am employed as security guard in Dubai from April 26,2003, i left the company after 4 year, then i start running a private business with my security company visa, and the visa expired on December 2009, and I was caught by Dubai police on January 2, 2010 by Dubai police, they stopped me when I was driving and they checked my drivers license and then they discover that my sponsor has put ran away on my visa status, so I was jailed for two days, and I bought my flight ticket back to my country, I have stayed in my country for one and half years now, so I want to return back to Dubai, but I am afraid because I don’t know the ban they gave me because they scan my ayes before I was deported, but some people told me that they might give me life ban, so I want to know if my sponsor have such power to impose on me life ban without committing serious crime except absconding case? I am working for a company called ETA - M&E in CCAD Project, as Manager - QA / QC in Abu Dhabi since 3rd Sep'2010. As the project director is using unparliamentary and nasty languages often apart from using South and North India discrimination, at the instruction of another higher ups who is above him, I requested for a transfer to some other Project and went on an emergency leave for 13 days. In the mean time I came to understand that they have posted some one in my Position on the 4th day left for India. I am forced to extend the Leave for another 7 days due to illness and when i have informed them they have replied back that they will not extend the leave asking me to send the passport to them thro. West Asia Exports for cancellation of Visa, for which I have refused and came back on 22nd July 2011 Night and Joined Duty on 23rd July 2011. They repeated the same that they will cancel the visa. I have applied for the return of deposited money,AED 5000 deposited (to get back my Passport from them while going to India)along with leave letter and supporting medical certificate and they have released the same on 24th July 2011 after taking my passport on 23rd July 2011, with rejoining form. Now I am not given any Job and I am visiting the Office everyday to know the Status. They said it will take 10 days to cancel the VISA. I have told them to issue me a Termination Notice, but they have refused to issue it initially and now searching for suitable reasons. I have asked them to Pay me Notice pay along with 25 days leave salary (leave salary for the 10 months that I have worked for) and Flight Ticket, but they are telling that they will do the settlement of Notice pay and Flight Ticket that too only after signing of papers and will not pay any leave salary.
Kindly let me know the plan of action that I have to take.
in your case you never completed one year,try to get notice preiod salary and ticket any pending salary

Employees who have been slapped with a six-month labour ban for breaking their contracts before the expiry of two years can work for a new company, provided they hold at least a high school diploma and have been offered a good position and salary by the new company, employers were told by the Ministry of Labour .
To lift the ban, an employee should have been offered a minimum salary of Dh5,000 for high school graduates, Dh7,000 for diploma holders and Dh12,000 for bachelor's degree holders.The salary must be mentioned in the labour contract. The new employer needs to submit the employee's educational certificate, which does not need to be attested at this stage. It will be scanned and entered into the Tas'heel system, and a new labour permit will be issued accordingly.
Is there any change in this law or still the same rule is in existing???
I resign in my company in jafz salary AED 1500 because I found job here in ajman near to my home, just walking distance for 10 minutes Salary AED 2700. Im just complete only 22 months but my visa will expire December 2013. When I sign the agreement they told me im free to quits my job after 18 months even though I did not finish my contract. Now I'm waiting for my cancelation, I'm afraid maybe I have ban.. Do still I have ban.. someone help me.. Thanks

Furthermore, i still have 3 months pending salary from my company where until now (14-02-2012) while I'm in my vacation, my company told me to send to me my salary but even a single fils, i received nothing and telling me that they will give my salary once i come back to my company in UAE. But, i decided not to come back anymore, due to have no enough money (to pay for my transpo, my accommodation, my food and other financial needs) to spend while in the UAE. I make a complain already to MOL with regards to this matter when I'm still in the UAE and disregard my complain when my company told me to give my previous pending salary (except the 3 months pending mentioned earlier). But what happen, after a few months. It goes back again for pending salaries. So I decided not to come back anymore to my company. Do I have a ban on this cause? If yes, how long? Will this be a 6months or 1 year or lifetime ban? I love to work in the UAE again but is it possible for me to come back again and work for new company?
