Residence Visa Transfer from Public sector to another Public sector in Dubai or other Emirates

This involves a description of procedures of Residency Department to offer Residence service for a resident Employee who transferred his/her sponsorship (within public sector) in Emirate of Dubai or any other Emirate.
Applicant: Sponsor, Agent
 Documents Required

  1. Application for residence visa transfer for public sector’s employee in Emirate of Dubai or any other Emirate prepaid through E-form includes 2 photographs of the sponsored + (signature + stamp of new sponsor).
  2. Copy of the (new) establishment card valid.
  3. Original passport of sponsored
  4. Application of sponsorship transfer prepaid and approved by (Entry permit Department)
  5. Valid original medical test or online.
Note: In case sponsorship application from another Emirate to Emirate of Dubai, approval form Directorate of Residency and Foreigners Affairs of previous Emirate is a must, then proceed with application in Directorate of Residency and Foreigners Affairs-Dubai.

Labour Ban and U.A.E Ministerial Decree 766 Rules for Work Permit

Ministerial Decree 766 of 2015 sets out new rules on work permits with result easing of labor bans .Rules and Conditions for granting a permit to a worker for employment by a new employer as per Decree 766
As per Ministerial Decree 766 and effective from January 2016 a new work permit will be issued and hence no labour ban arises in the following circumstances (applicability to each type of contract illustrated in the relevant columns). Clearly the changes provide for a more fluid labour market and greater employee mobility. The circumstances in which labour bans can be issued are so radically.

Either party unilaterally terminates the employment relationship after the expiry of the first fixed term contract provided that:

a)     The terminating party gives notice to the other party as per the MOL Contract;

b)     The terminating party continues to honor the contractual obligations for the duration of the notice period; and

c)     The terminating party indemnifies the other party in the amount that was agreed to in the MOL Contract.

This provision  appears to have been written purely with intention of addressing where an employee resigns during the term of the contract (as otherwise an employee would not be entitled to a new work permit if the employer was in breach of (b) which does not appear to be the intention of the legislation).

The new changes certainly add transparency and clarity for U.A.E Labour Law on issues such as offer letters and termination provisions. The greater workplace mobility provisions are likely to have an immediate impact on the labour market and it will reflect in U.A.E economy

The main beneficiaries of the changes will be blue collar workers and those recruited from aboard by unscrupulous companies offering terms and conditions that are not then honoured in the UAE.

Visa processing Charges U.A.E

 The Visit Visa applies to tourists who wish to spend more than 14 days in UAE, those coming for family visits as well as those on long-term business visits. It requires the sponsorship of any UAE resident or any company or hotel licensed to operate within the UAE.

Brigadier Dr Rashid Sultan, a spokesperson for the UAE Ministry of Interior, said the ministry was re-implementing the decision No 337 of the year 2004 to enable all those who have visit visas to get an extension.

"All companies and visitors should submit applications and transactions before the expiry date of the visa period to avoid violations. The immigration services will be provided at all UAE port of entries and immigration offices," he added.

The official said the new rule is applicable for all entry permits. These permits would include transit visas, short-term (one month) and long-term visit (90 days) visas, student visas, visas for medical treatment and residence visas.

In the previous visa requirements, visit visa holders needed to exit the country after the expiry of the visa term and had to stay out of the country for at least a month before being able to re-enter on another visit visa.

He said that amending of visa status will be done electronically and without complications as part of the new procedure. People do not need to the leave the UAE, but they can amend their visa status and pay the required fees in order to facilitate the transactions for visitors and residents and to save money and time.

Obaid bin Suroor, Deputy Director of General Directorate of Residency and Foreigners' Affairs in Dubai, said that all the decision issued by the Minstry of Interior will be implemented by all immigration departments.

The UAE has revoked the condition of a one-month gap for renewing visit visas. People on such visas will no longer need to exit the country to get an extension of their stay here. They can now do it by paying Dh570 and stay for a month more without exiting the country.

How to Cancel the Sponsor’s Residence Visa without the Sponsored Persons in UAE

  Procedures
This involves a description of procedures of Naturalization and Residency Administration/Dubai to cancel the visa residence of a labor sponsor or labor sponsor under residency and foreign affairs (partner or investor) without canceling the visa residence of the sponsored persons.

Documents Required
  •      The documents to be required shall be upon the entity in which he shall work for:
  •      In case of having a work opportunity in the private sector, then the Documents Required shall be :
  •        Cancellation applications.
  •       Work permit issued from the ministry of labor with the salary certificate from the company or the initial approval from the ministry of labour that the salary not to be less than 3000 AED with accommodation or 4000 AED for the allowable jobs.


·         In case of having a work opportunity in the governmental or semi-governmental  sector, then the Documents Required shall be :

1-     Cancellation applications.
2-     Salary certificate provided the salary not to be less than 4000 AED and over or 3000 AED + accommodation.

But the other documents are as follow:
1-     The concerned original passport
2-     Copy of the sponsored passports with the visa residence, the sponsored should be inside UAE.
3-     Cancellation certificate approved by the ministry of labor ( Private sector )
Or the cancellation applications attested from the General Directorate of residence and foreign affairs (public sector).
4-     The UAE original identity card


Fees Required
1-     70 AED cancellation fees to be paid through e-form at the typing centers  to be broken down as follows:
50 AED cancellation fees
 (10) AED Knowledge Dirham.
(10) AED service charges.


2-(5030) AED a refundable deposit upon issuing the sponsor a new visa residence , to be broken down as follow:
(5000) AED refundable deposit fees
10 AED bank charges
          (10) AED administrative fees..
         (10) AED Knowledge Dirham.

3-130 AED local fees for sponsored closure, broken down as the following :
         100 AED local fees   
          (10) AED administrative fees..
          (  10) AED bank charges.
        (10) AED Knowledge Dirham.

The penalty fees to  be calculated on the local system as per the statement of the public prosecutor   as the following:
(15) AED cash for each day during the first  6 months  , means for (180 days)
(30) AED cash for each day during the second  6 months  , means for (180 days)
(50) AED cash for each day passing after a year or more.

Penalty fees on the ministry system:
(25) AED cash for each day during the first  6 months  , means for (180 days)
(50) AED cash for each day during the second  6 months  , means for (180 days)
(100) AED cash for each day passing after a year or more.

 Applicant Notices 
The interim closure procedure on the family passports until amending the sponsor’s status .
-       The sponsored may not leave the country at the closure period until amending the sponsor’s status and release the interim closure of the sponsored.
