No six-month work ban from January 1, 2011 in UAE

Expatriate workers can move to new employment without no-objection certificate if they have served out two-year contract.The Ministry of Labour has issued regulations allowing workers who finish their contracts to obtain new work permits without undergoing the six-month work ban, and allowing them to move to other firms without the employer's approval from January 1, 2011.
A worker with an expired contract can obtain a new work permit and shift to another employer without the passing of the currently legitimate six-month period and consent of his sponsor, according to the new resolution issued by the Minister of Labour Saqr Gobash.
The new regulations on conditions and criteria of issuing new work permit for a worker after the expiry of his service contract and transfer of sponsorship will take effect as of January 1, 2011 in implementation of the cabinet resolution No 25 of 2010 regarding internal work permit at the Ministry of Labour.
Once operational, the new regulations will replace the current formalities of transfer of sponsorship for expatriate workers.
The resolution says that the new employment permit will only be granted to the worker after the end of his work relationship with his employer without consideration of the legitimate six month period which is usually calculated after the cancellation of the worker's labour card.
But it stipulates two must-do conditions. firstly, the two contracting parties must have ended their work relationship cordially and secondly, the worker should have worked with his employer for two years at least- the duration of the new labour card which will be issued by early January.
The resolution defines two cases where the worker can obtain the new work permit after the end of the contractual relationship without the agreement of the two contracting parties.First, when the employer fails to honour his legally or contractual obligations. Second, in the condition of expiry of work relationship where the worker takes no responsibility such a complaint filed by the worker against his firm.
In this case, an inspection report should prove that the firm is out of business for more than two months and that the worker should have reported to the ministry.
The labour dispute should have been referred by the ministry to the court provided that the court hands out a final verdict ordering the employer to pay to the worker salaries of two months at least, compensation for the arbitrary sacking or terminating the contract prematurely, or any other rights.
The resolution also defines three cases where the worker shall have the right to get a work permit without fulfilling the condition of working two years at least with the employer.Firstly, when joining his new job, the worker should be classified in the first, second or third professional class and that his new salary should not be less than Dh12,000, Dh7,000 and Dh5000 in the first, second and third class respectively.Secondly, non-compliance of the employer with legal, labour obligations towards the worker or in the case where the worker has no role in terminating the work relationship.
Thirdly, shifting of the worker to another firm the employer owns it or has stakes in it.Minister of Labour Saqr Gobash said the new measures aim to infuse broader flexibility in the labour market and strike a balance in the contractual relationship between the employer and worker."The Ministry will only interfere in the employer-worker contractual relationship if it detects infringement in obligations stated in the labour contract," he explained, affirming the ministry's determination to guarantee rights of both parties legally as we live in the State of law and institutions.
"Giving the private sector more freedom of movement will have automatic impact on employers by the way of preserving their interests through creating many options for recruiting skillful workers as per the supply-demand equation.
He indicated the new measures were subject to dialogue and consultation with local stakeholders in implementation of directives of the wise leadership for crafting policies and legislations that fit well into the developments in labour market and curb any malpractices.
"The new regulations constitutes key elements of labour reforms which part of them have already executed and the other parts will be in place in the near future," he said.These measures, he said, were expected to play a major role in advancing efforts towards creating an efficient labour market and sharpening competitiveness and transformation towards a knowledge-drive economy.

Unknown if this is current information (DNRD document is undated). Last checked 01 March 2009 but document appears to be more than a year old, so may have been superseded by changes to UAE visa rules in 2008.

Im currently working at a trading company now for a year and seven months. My contact will be finished on July 2012..It was indicated in the new rule that if you can finished the 2 years of service, you can transfer to another job if you with ease. Is it also applicable on my case? My original contract is for 3 years..

I was employed in a Consultant Firm as an Engineer also in my labor Card but my job is purely Doc. Controller, Secretary and Receptionist with a very small salary. I am now one year and six months in the service. My contract is 3 years and will end by July 2012. With the new UAE labor law, can I swift to another job?even if I will not reach the 2 years of service and my visa is Enginer. Please advise me if I can swift to another job already because my salary really is not enough and not worth it with my degree and with so many load of work, please I need your advise.....

I was removed from a private company, after just working with them for 6 months.So I believed I have a 6 month's ban period ....My ban period starts from October 2010..So I still have 3 more months for my ban period (Jan 2011 to end of March 2011)...

But according to the new rule, will my ban be cancelled now ???

I have been looking for a job in fee zone areas, but response very slow !!! In dubai companies I can't try as they ask for NOC which I didn't get even after lots of pleading from my previous company ....

Guys please help me...what is the true picture so I can accordingly apply for jobs ....

Ive been on unlimited contract which is expired last oct 28,2010 and i had a renewed labor card then i filled my resignation which ends also on the same date as per my unlimited contracts end. I have now my new employer and they already filled a visa application and it is rejected because they need the NOC.For this new labor law, it can be reapplied again and no ban at all?

i am working in a gym as a receptionist for 14 months. But if i will resign i have to pay for my visa cost since i did not finish atleast 2 years contract with the Company. I really wanted to get out of this Company. Just by not doing a task we we're already deducted 200aed for that. Is that allowede in the labor law? the new rule allow some workers who cannot read and write to move freely shifting from one job to another!also, employers have the responsibility handle all their vizas , fees etc....

At the same time , other countries bring and issue work permits for workers who must have at least secondry certificates to under the country.

what bout housemaid position? My cousin finish her contract for one year by Jun 7 as housemaid. She dont want to renew anymore as she wants to go another big company. Her sponsor was telling she has to go exit dubai but we are afraid they will give 6 months ban. Is there any possibility she dont have to exit UAE to change her visa as she ended already her house maid contract? Dear, you are working with your employer for 3 years and if you wish to join any other company, you must resign your job giving one month notice, provided if your contract is unlimited contract. then 6 month ban will not attract

I wrote in to inquire whether i am banned or not in UAE. I left las Nov. 2010 my visa is only on the 4th month (housemaid visa) I have been working for the same employer for 5 years when he transferred my visa to his local sponsor. It is not clear from your question you are under bank visa or dependent visa. If you are holding visa under bank when you are resigning you must cancel the visa then you will get aban

Now the company going to terminate lots of employee without any valid reason bcoz of company internal crises.So can i change my current job if employer terminate me. It is not clear from your question you are under bank visa or dependent visa. If you are holding visa under bank when you are resigning you must cancel the visa then you will get aban

hi..i am working in a private area for almost 7months in dubai... and for unknown reason i was terminated.i didn't get any payment except from my salary. the company told me that i have 6 months ban at labor.now,i'm here in phils and i was hired by another private company in abudhabi. my ban will be finish by december2011. just want to know if it is possible to process work permit before the ban gets finish?or am i also ban in abudhabi area?

To lift the ban, an employee should have been offered a minimum salary of Dh5,000 for high school graduates, Dh7,000 for diploma holders and Dh12,000 for bachelor's degree holders.The salary must be mentioned in the labour contract. The new employer needs to submit the employee's educational certificate, which does not need to be attested at this stage. It will be scanned and entered into the Tas'heel system, and a new labour permit will be issued accordingly.

if u have a limited contract say 2 years and if u wish to change your job then u must have a no objection letter from your employer .this will give you the right to work with another employer, if u dont have it and u still switch job the employer will be liable to put a ban for you , if u change jobs no matter if its a 6 months or 1 year u will still get a ban if your employer doesnt agree to give u a no objection letter from the company. the safest way is to find a employer and then as the new employer to issue a no objection letter if the current employer agrees then you wont have a ban .

I am working in sharjah in a construction company as a civil engineer but my salary is too much less & my visa stamped before 2 months my aggrement is of 2 years now i want to change my job as i have a good offer so can i change it>

Employees who have been slapped with a six-month labour ban for breaking their contracts before the expiry of two years can work for a new company, provided they hold at least a high school diploma and have been offered a good position and salary by the new company, employers were told by the Ministry of Labour .
To lift the ban, an employee should have been offered a minimum salary of Dh5,000 for high school graduates, Dh7,000 for diploma holders and Dh12,000 for bachelor's degree holders.The salary must be mentioned in the labour contract.

I am here on my husband visa, same at work. I am still on probation but want to quit bcoz my baby can't adjust in a day care. There was no mention of any contract, is it by default. If i started work in July this year when should i quit (the soonest)?

I am still on a 3 month probation period with a semi government organisation in Abu Dhbai as a Manager and hold an MSc. I have been offered a position with a government organisation in Dubai. Will I get a ban or as I am led to believe Government organisations are exempt from bands/NOCs?

I am working in a contracting company and I work as a Quality Controller but my visa is Cleaning worker. I have been working in the said company for 9 months now but the real problem is our salary, it has been delayed for 4 months. If i resigned will there be a ban for me even though if i tell them that we are not receiving our salary on time.

hi!my arbab wont cancel me he just gave 1month vacation amonth salary and 2way ticket,i told him just cancel me but he wont!the reason why i want cancel is 3mos delayd salary 12hrs work no overtime pay no holiday,i applayed for another com.i was hired i have my offer letter now they will give visa once im cancel in my current com.i only finish 21months in my 3yrs visa unlimited,is ther anyway u can advise me whats the best i should do?please!thank you so much

Hi, I worked as a Sales Engineer in Dubai last 2007 to 2008..After 1 year and 3 months I went home and have vacation, and my contract is 3 years.However I didnt come back anymore because of some personal reasons. And my employer file a absconding ban to me. now is almost 3 years since I didnt come back in UAE. Is the abscond still there? or is being lifted? It is possible to work in other GCC countries with abscond file in UAE? Please help me to answer this questions asap.thanks

I am a Post graduate in Commerce and having 5 years of work experience in Accounts in a fortune 500 listed MNC Co in Bangalore,India. My problem is, that I am presently working for a low salary job . It is difficult to meet even my day to day expenses. So I would like to change my job without getting a six months VISA ban. Presently I have completed 1 year in this job. and I am getting only 1,500/- DHS as a monthly salary without accommodation . I have problem with my visa status. my boss gave me employment visa dec and expired feb i go through medical exam and i got the result. the the ministry of residency and foreign affairs text me to go to thier office but i didnt go bcoz my supervisor said its ok will just wait for the boss to process the residency visa when he come back from france but the boss didnt finish the process of the papers until the store close last march 18. now i dont know what to do hs not answering my call. the pro said i already have penalty that is around 1, 350 but i dont know how to pay that because he didnt also give our 3 month salaryplus i am thinking since my employment visa is expired police might put me to jail.. can u please explain to me what to do? thank you...

Hi, I recently resigned from a semi-government bank in Abu Dhabi and accepted an offer with another semi-govt bank in Abu Dhabi. I served 2 years and 3 months with my current e mployer. I have requested my current employer to facilitate in visa transfer to my new employer, however they are refusing to do so. I don't have a labor card. Can my current employer refuse visa transfer given the fact that my resignation was accepted and that i will settle all liabilities? Secondly if they cancel my visa will i get a ban ? lastly can my new employer will still be able to issue a new visa after my visa is cancelled ?
